Is Weed Legal in South Africa? What the Law Says in 2026

By the SmileyIrie team · Last reviewed

Partly. Adults in South Africa may use, possess and grow cannabis (long known locally as dagga) in private for their own consumption. That has been protected since the Constitutional Court ruled on it in 2018. Buying and selling cannabis is a different matter: there is still no licence for recreational cannabis sales, and dealing in cannabis remains an offence. This guide explains where the line sits as of November 2026.

This is general information, not legal advice. The law is still changing: the regulations that will set exact limits were in draft when this was written. Check the current position, or ask a lawyer, before you rely on it.

    The 2018 Constitutional Court ruling

On 18 September 2018, in Minister of Justice and Constitutional Development v Prince, the Constitutional Court found that criminalising the use, possession and cultivation of cannabis by an adult, in private, for personal consumption, was an unconstitutional invasion of privacy.

The ruling protects what an adult does privately. It did not create a legal way to buy or sell cannabis, and it did not cover use or possession in public.

The Cannabis for Private Purposes Act

Parliament's response to the ruling, the Cannabis for Private Purposes Act, was signed into law in May 2024. It is meant to write the private-use rights into legislation and to set quantity and plant limits through regulations. Draft regulations were published for public comment in early 2026. When this guide was last reviewed, those limits were not final, and sources disagreed on whether the Act had formally come into operation.

The Act deals with private use. It does not license shops, clubs or delivery services to sell cannabis.

    What's protected and what isn't

Protected for adults (18+), in private

    • Using cannabis at home or on other private property
    • Possessing cannabis for your own consumption, in private
    • Growing cannabis for your own consumption, in private

    Still illegal

    • Selling or dealing in cannabis. There is no licence for recreational sales. The only lawful commercial channels are medical cannabis authorised by SAHPRA and hemp grown under permit.
    • Using or possessing cannabis in public, which the 2018 ruling did not cover
    • Driving while impaired by cannabis
    • Supplying cannabis to anyone under 18
    • Taking cannabis across international borders, in either direction

So, is it legal to buy weed online?

Not in the way buying alcohol is. No online or physical recreational cannabis shop in South Africa holds a licence to sell, because that licence does not exist yet. The private-use protection covers you as an adult user. It does not make the sale itself lawful.

Medical cannabis can be obtained lawfully with a prescription, through SAHPRA's authorisation routes. Outside that, private clubs and online stores operate in a grey area rather than a regulated market. If you buy this way, do it knowing that.

SmileyIrie sells only to adults aged 18 and over, for private use, and delivers in plain, sealed packaging.

    How much can you have?

There is no final legal limit yet. The Act leaves possession and plant limits to regulations, and the 2026 draft regulations proposing them were still open to change when this guide was reviewed. Figures you may see quoted elsewhere come from earlier drafts of the bill, not from law in force.

Until limits are final, keep quantities clearly consistent with personal use. Large amounts, scales or packaging that looks like it is for sale can be treated as evidence of dealing.

    Growing at home

Adults may grow cannabis privately for their own use. Plant limits are among the details the regulations will set. Keep plants out of public view and out of children's reach, and don't sell or trade what you harvest: that falls outside the private-use protection.

    Cannabis and your job

The right to use cannabis privately does not override workplace rules. Employers can still set drug and alcohol policies and test for impairment, especially in safety-sensitive work such as mining, driving or operating machinery. THC can be detectable for days after use, well after its effects wear off.

    Travelling with cannabis

The protection is about private places. Carrying or using cannabis in public, including in a car on a public road, isn't covered the same way. Never take cannabis across an international border: it is illegal in most countries and the penalties can be severe.

    Where the law is heading

Government has discussed a regulated commercial cannabis market for years, alongside the existing hemp and medical frameworks, but there is no confirmed date for licensed recreational sales. We'll update this guide when that changes.

    Using cannabis responsibly

    1. Keep it private: use cannabis at home or on private property.
    2. Adults only: never share with anyone under 18.
    3. Store it securely: lock edibles away from children and pets. They look like ordinary sweets.
    4. Don't drive: wait until you are fully unimpaired, which takes longer after edibles.
    5. Start low: new to edibles? Read our edibles and dosing guide first.
    6. Stay informed: the regulations are still being finalised.
